In occasional situations an emergency Will is required, and we are happy to provide this service. If an emergency Will is required we shall treat this a priority.
Emergency Wills are usually required when the health of a person is deteriorating, or they are in hospital or indeed a hospice.
We act locally for recommendations from a local hospice, and often a situation arises where a member of our staff attends the hospice with a member of family to obtain instructions.
We have had situations where we have returned to the office, prepared the Will, then returned to the hospice in a matter of hours for the Will to be signed. It obviously depends on the nature of the estate, as to the instructions.
One important criteria is what’s known as ‘capacity’. This means that the person who is making the Will has the necessary capacity to understand the contents of the Will, to understand the consequences of their instructions, and to understand that a Will is being prepared and witnessed.

This is sometimes a bar to emergency Wills, but it is very rare for this to occur, as usually the family, and the medical practitioners shall give guidance as to the Testator’s (the person making the Wills) Mental Capacity.
