Widow challenges will that left her £36,000 out of £12 million estate despite serving divorce papers.
A widow who left her husband two years before he died – serving divorce papers just two months before his death is challenging the will which left her just £36,000 of the £12 million fortune.
During the later stages of his illness the testator made a will that left his estate to his two sons aged 26 and 28.
However his bereaved wife of forty years is contesting the will principally on the basis that if the divorce had been settled before her husband had died she would have received 50% of the £12 million.
If successful the £6 million award would be the largest ever awarded by an English Judge in such a case. However the widow is not alone as the deceased two sisters are also claiming against the estate.
It would appear on the face of it that the widow has a good case and one of the things that would be considered by the court is the provision the applicant (widow) might reasonably expect to have received if the marriage had been terminated by divorce rather than death.
