A Case Settled – difficult executors

We recently settled a long outstanding matter where Mr P had died leaving his entire estate to his wife Mrs P – However Mr P appointed a friend as sole executor who travelled back and forth to Spain during the year. The executor was failing in his duty to act reasonably and was delaying and being obstructive in the administration.

We forcibly pointed out his duties and his personal liability in dealing with some of the estate administration matters.

After a period of negotiations it was agreed the executor would renounce his executor and with his consent we applied to the court for Mrs P to be the new executor.

The administration was completed which involved the sale of some foreign properties.
